Terms and Conditions

These Terms & Conditions (“Terms”) govern the business relationship between Michelle Alexis Reber – Lycrus (“Photographer”) and the client (“Client”).


They apply to all photography services and offers provided by the Photographer, including but not limited to business photography, event coverage, corporate photography, and other photography sessions.


1. Scope of Services


The exact scope of each photography assignment will be agreed individually between the Photographer and the Client.


The agreed services may include, among other things:


  • Date, time, and location of the assignment
  • Duration of the photography session
  • Type and scope of coverage
  • Number of delivered images
  • Delivery format
  • Delivery timeframe
  • Agreed fee and any additional services


The specific details of the assignment will be set out in the applicable offer, quotation, order confirmation, or other written agreement.


2. Booking & Reservation


A booking becomes confirmed and binding once:


  1. the Client has accepted the Photographer's offer in writing (for example, by email); and
  2. the Photographer has confirmed the booking in writing.


By accepting the offer, the Client acknowledges and agrees to these Terms & Conditions.


Quotes, inquiries, and preliminary correspondence do not constitute a confirmed booking or reservation of the requested date.


The requested date is considered reserved only once both the Client's acceptance and the Photographer's confirmation have been provided in writing. Until then, the Photographer remains free to accept other bookings for the same date.


Bookings are generally confirmed on a first-come, first-served basis.


3. Cancellation & Non-Appearance


3.1 Cancellation by the Photographer


If the Photographer is unable to perform the agreed services due to force majeure, including but not limited to serious illness or a death in the immediate family, the Photographer is not obliged to provide a replacement photographer.


However, the Photographer will make reasonable efforts to find a suitably qualified substitute where possible.


If the Photographer is unable to provide the agreed services, any payments made for services that were not performed will be refunded in full.


To the extent permitted by applicable law, the Photographer shall not be liable for additional damages or consequential losses resulting from such cancellation.


3.2 Cancellation by the Client


The Client may cancel a confirmed booking at any time without providing a reason.


To compensate the Photographer for work already performed, preparation, administrative costs, and the potential loss of another booking opportunity, the following cancellation fees apply:


  • 7 days or more before the event: Cancellation is free of charge.
  • 6 to 3 days before the event: A cancellation fee of 50% of the agreed fee will be charged.
  • Within 2 days of the event: A cancellation fee of 100% of the agreed fee will be charged.
  • No-show: A cancellation fee of 100% of the agreed fee will be charged.


The applicable cancellation period is determined by the date and time on which the Photographer receives the Client's written cancellation.


If an event cannot take place due to force majeure or circumstances beyond the Client's reasonable control, the Photographer may, at their discretion, make an exception to the applicable cancellation fee.


4. Image Delivery


Unless otherwise agreed in writing, the edited images will be delivered within 7–10 days after the event or photography session.


If the Client requires delivery before the standard delivery period, an additional rush fee may apply. The applicable fee will be agreed separately before the expedited delivery is undertaken.


File Format


The standard delivery format is JPEG.


RAW files are not included in the standard delivery. RAW files may be provided upon request and are subject to an additional fee, which will be agreed individually.


5. Copyright & Usage Rights


5.1 Copyright


The Photographer retains the full and exclusive copyright and all intellectual property rights in the photographs created as part of the assignment.


The Client does not acquire ownership of the photographs through payment of the agreed project fee.


5.2 Client License


Subject to full payment of the agreed fee, the Client receives a worldwide, perpetual, non-exclusive license to use the delivered images for the Client's own:


  • marketing purposes;
  • promotional activities;
  • business communications;
  • website and social media;
  • public relations and press activities; and
  • other business-related purposes.


The Client may share and distribute the images to event partners, sponsors, participating brands, and other parties directly involved in the respective event or project.


5.3 Use by Event Partners & Third Parties


Third parties receiving the images from the Client are granted a limited right of use solely for purposes directly connected to the respective event or project, including:


  • event coverage;
  • event promotion;
  • marketing related to the event;
  • press and public relations; and
  • related communications.


The images may not be sold, relicensed, sublicensed, transferred for unrelated commercial purposes, or otherwise commercially exploited by third parties without the Photographer's prior written consent.


6. Credit & Attribution


6.1. Commercial Use


Unless otherwise agreed, credit to the Photographer is not required for commercial use of the photographs.


6.2. Editorial & Social Media Use


When the photographs are used in editorial contexts or on social media, credit to the Photographer is appreciated.

7. AI & Automated Image Manipulation


The license granted under these Terms does not include the right to materially alter, manipulate, transform, recreate, or generate derivative versions of the photographs using:


  • artificial intelligence (AI);
  • generative AI;
  • machine-learning tools;
  • automated image-generation systems; or
  • other automated image-manipulation technologies.


Any such use requires the Photographer's prior written consent.


This restriction does not prevent ordinary editing and adjustments that are consistent with the intended use of the delivered photographs, such as standard cropping, resizing, compression, or formatting.


8. Unauthorized Use


Any use of the photographs outside the rights granted under these Terms constitutes unauthorized use.


In the event of unauthorized use, the Client or third party responsible for the infringement shall, in addition to the agreed project fee, be liable for compensation amounting to 150% of the originally agreed project fee, to the extent permitted by applicable law.


The Photographer reserves the right to pursue any additional claims or remedies available under applicable law.


9. Portfolio & References


The Photographer may refer to the collaboration and use photographs created during the assignment for portfolio, website, social media, marketing, and other professional reference purposes.


If the Client does not wish certain photographs to be published, the Client must explicitly inform the Photographer of this request.


Where possible, such restrictions should be communicated before or at the time of the booking.


Any specific confidentiality or publication restrictions agreed separately in writing take precedence over this general permission.


10. Data Protection & Third-Party Rights


The Photographer treats information provided by the Client as confidential and processes personal data only to the extent necessary for the business relationship and performance of the agreed services.


Personal data will not be disclosed to third parties unless required for the performance of the contract, required by law, or otherwise permitted by the Client.


10.1 Persons Depicted


If the Client identifies or provides persons to be photographed, the Client is responsible for ensuring that all necessary consents have been obtained from those persons for the intended use of the photographs.


10.2 Objects & Locations


If the Client provides objects, materials, premises, or specific locations to be photographed, the Client is responsible for ensuring that no third-party rights prevent the intended creation and use of the resulting photographs within the agreed scope of the assignment.


11. Defects & Complaints


The Photographer shall be liable for defects only in cases of intentional or grossly negligent conduct, to the extent permitted by applicable law.


The Client acknowledges that photography involves artistic and creative judgment. Differences in artistic style, composition, lighting, color interpretation, or creative approach do not constitute defects where the delivered work corresponds to the agreed scope of services.


The Client must notify the Photographer of any defects or complaints in writing within 10 days of receiving the delivered files.


If no written complaint is received within this period, the photographic work shall be deemed accepted, to the extent permitted by applicable law.


12. Fees & Payment


All prices are stated in Swiss Francs (CHF) unless otherwise agreed in writing.


The Client must pay the applicable invoice within 30 days of receipt.


If payment is not received by the due date, the Client is considered to be in default.


In the event of late payment, the following reminder fees may apply:


  • First reminder: CHF 10
  • Second and final reminder: CHF 20


Any additional reasonable costs incurred as a result of necessary debt collection, legal action, or court proceedings may be charged to the Client to the extent permitted by applicable law.


13. Severability


If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, in whole or in part, the validity and enforceability of the remaining provisions shall remain unaffected.


The invalid or unenforceable provision shall, where legally permissible, be replaced by a valid provision that most closely reflects the original purpose and economic intent of the provision.


14. Acceptance of These Terms


By confirming a booking with the Photographer, the Client acknowledges that they have read, understood, and accepted these Terms & Conditions.


The specific terms agreed in an individual offer, quotation, order confirmation, or separate written agreement shall apply in addition to these Terms.


Where there is a conflict between these Terms and a specific written agreement, the specific written agreement shall take precedence.
