Terms and Conditions
INTRODUCTION
Welcome to the website lycrus.com. These Terms and Conditions govern the business relationship between Michelle Alexis Reber (hereinafter referred to as “the Photographer”) and her clients.
These Terms and Conditions apply to all services and offers provided by Michelle Alexis Reber – Lycrus, in particular business shoots, event coverage, and other types of photography sessions.
SCOPE OF SERVICES
The exact scope of services (e.g. number of images, duration of the shoot, editing style, delivery format) will be agreed individually and set out in writing in the offer or order confirmation.
BOOKING/RESERVATION
A booking is considered confirmed once the proposed date and details have been accepted in writing. The Terms and Conditions are deemed accepted.
Quotes, offers, or preliminary correspondence do not constitute a binding booking or reservation of the requested date. Dates are reserved only upon written booking confirmation by the client and acceptance by the photographer. Until such confirmation is received, the photographer reserves the right to accept other bookings for the same date on a first come, first served basis.
CANCELLATION OR NON-APPEARANCE
On the Photographer’s Side: If the photographer is unable to attend due to force majeure (e.g. illness, death in the family), they are not obligated to provide a replacement. However, they will make their best effort to find a qualified substitute. Any payments for services not performed will be fully refunded. Claims for damages are excluded.
On the Client’s Side: The client may cancel the booking at any time without giving a reason. To compensate for work already carried out and potential lost opportunities, the following fees apply:
- Up to 7 days before the event: free of charge
- 6–3 days before the event: 50% of the agreed fee
- From 2 days before the event or in case of no-show: 100% of the agreed fee
If the event cannot take place due to force majeure, the photographer may make exceptions.
IMAGE DELIVERY
The images will be delivered within 7-10 days after the event, unless otherwise agreed. If the client requires an earlier delivery date, an additional rush fee will apply.
Images are delivered in JPEG format only. RAW files can be provided upon request for an additional fee to be negotiated.
USAGE RIGHTS & PUBLICATION OPTIONS
The photographer retains full and exclusive copyright to all images. All rights to the images remain with the photographer.
The client is granted a worldwide, perpetual license to use the images for their own marketing, promotional, and business purposes, including sharing and distributing them to event partners, sponsors, and participating brands.
Such third parties are granted a usage right limited exclusively to use in direct connection with the respective event, including its coverage, promotion, and related communications.
Further distribution, particularly the sale, licensing, or sublicensing of the images to third parties, is not permitted without the express prior written consent of the photographer.
If any use of the images is made in breach of this agreement, the breaching party (whether the client or any third party) shall, in addition to the agreed project fee, be liable to pay compensation amounting to 150% of the originally agreed fee for such unauthorized use.
REFERENCES
The photographer may mention the collaboration and use the images for portfolio and reference purposes, unless the Client explicitly requests that certain images are not published.
DATA PROTECTION
The photographer treats all shared information as confidential, stores only personal data necessary for business transactions, and does not disclose such data to third parties.
If the client has specified to the photographer which persons are to be photographed as part of the photographic work, the client is responsible for ensuring that these persons have given their consent to the use of their images in the manner intended by the client.
If the client has provided the photographer with objects or specified locations to be photographed as part of the photographic work, the client is responsible for ensuring that no third-party rights prevent the intended use of the resulting images of such objects or locations within the scope of the photographic work.
DEFECTS
The photographer is only liable, including for defects, in cases of intentional or grossly negligent conduct. Complaints regarding the photographer’s artistic discretion are excluded.
The client must report any defects in writing within ten days of receiving the files; otherwise, the photographic work shall be deemed accepted.
PAYMENT TERMS
All prices are stated in CHF (Swiss Francs).
The Client must pay the invoice within 30 days of receiving it. If the invoice is not paid by the due date, the Client is considered late with payment.
In case of late payment:
- A first reminder fee of 10 CHF will be charged.
- A second and final reminder fee of 20 CHF will be charged.
- Any additional costs caused by involving a debt collection agency, lawyer, or court proceedings will be the responsibility of the Client.
SEVERABILITY CLAUSE
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
